Inheritance law is the branch of law that governs to whom a person’s estate will pass upon their death and under what principles, the rights and obligations of heirs, and the legal procedures related to the distribution of the estate.
Nacar Law provides legal support to its clients in matters related to inheritance, estates, the distribution of inheritances, and disputes arising among heirs, taking into account the specific circumstances of each case.
The Scope of Inheritance Law
The fundamental provisions governing inheritance law in Turkey are set forth in the Turkish Civil Code No. 4721. Topics such as the opening of an estate, statutory and designated heirship, dispositions upon death, the reserved share, the acquisition of an inheritance, its renunciation, and its distribution are addressed under these regulations.
Upon the death of the decedent, the legal status of the estate and the rights of the heirs come into play. Determining the scope of the estate, identifying the heirs, and conducting estate-related proceedings in accordance with the law are important in light of potential future disputes.

Distribution of an Estate and Disputes Among Heirs
In cases where there are multiple heirs, a joint tenancy may arise over the assets included in the estate. During this process, which continues until the estate is distributed, disputes may arise among the heirs regarding the administration, use, and distribution of the estate.
If the heirs reach an agreement, the estate may be distributed by mutual agreement. If an agreement cannot be reached, however, legal action may be considered depending on the specific circumstances of the case.
In cases where real property is included in an estate, it may be necessary to consider the provisions of both inheritance law and real property law together.
Will, Reserved Share, and Reduction
The testator may make dispositions of property upon death regarding how his or her estate is to be distributed after his or her death, within the limits established by law. A will and an inheritance agreement are among the legal procedures that can be used in this context.
The Turkish Civil Code provides for reserved shares for certain heirs. Whether the testator’s dispositions violate the reserved share must be assessed by taking into account the inheritance relationship and the nature of the dispositions made.
If the legal conditions are met, disputes may arise regarding claims for reduction to protect the reserved share or the validity of dispositions upon death.
Renunciation of an Inheritance and Valuation of the Estate
An estate may consist not only of the value of the assets but also of the decedent’s debts. For this reason, it is important to assess the legal and financial status of the estate, particularly when there are debts.
The renunciation of an inheritance is subject to the conditions and time limits set forth by law. For this reason, the status of the estate and the legal consequences of the action must be carefully evaluated before a decision is made regarding the acceptance or rejection of the inheritance.
